Cloud Mission Enterprises, owner of the Reservation Quest (RQ) platform

These Terms of Service (“Terms of Service”) govern your use of the mobile application services, the internet, and the business tools provided by the Reservation Quest (RQ) Platform.

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. THIS IS A LEGAL AGREEMENT BETWEEN RQ AND YOU WHICH GOVERNS YOUR USE OF THE SERVICES. YOUR USE OF THE SERVICES CONSTITUTES YOUR ACCEPTANCE OF AND AGREEMENT TO ALL OF THE TERMS AND CONDITIONS IN THESE TERMS OF SERVICE AND YOUR REPRESENTATION THAT YOU ARE 18 YEARS OF AGE OR OLDER. IF YOU OBJECT TO ANYTHING IN THESE TERMS OF SERVICE, YOU ARE NOT PERMITTED TO USE THE SERVICES

Accepting these Terms of Service and using the Services on behalf of a company, organization, government, or other legal entity, you represent and warrant to RQ that you have full power and authority to do so.

The Services are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. Unauthorized reproduction or distribution of the Services, or any portion of them, may result in severe civil and criminal penalties, and will be prosecuted to the maximum extent possible under the law. The Services are licensed, not sold.

RQ Services

RQ is a platform that connects the services like but not limited to Clinic, Beauty Salon, Barber, Lounge, Sea, Vet, Catering, Artist, Sport, Cars services and more (collectively or individually, "Professionals") providing Care, Grooming, Lounging, Sea activities, Partying, Car services and others with clients seeking such services ("Clients" or "you").

Reservation Quest (RQ) solely provides a platform for business owners and customers to connect and serves only as an intermediary to facilitate communication to provide services.

Reservation Quest (RQ) does not provide services, and Employers and Clients contract independently to provide services. Reservation Quest (RQ) has no control over the quality, suitability, timeliness, non-compliance, failure to provide services, or any other aspect of any services provided by Employers.

Each client is solely responsible for their selection of a professional, the services to be provided, and the location where the services will be performed, whether at the professional's premises or at a specific location specified by the client. Any decision by the client to receive services or by the professional to provide services is made at that individual's sole discretion and at their own risk. All users understand and acknowledge that

(1) (RQ) Do not conduct personal background checks on customers or business owners providing the service.

(2) Providing services in a private location inherently increases the risks to both clients and professionals.

 (a) Refusing to provide services to clients if they have raised the level of risk to the client.

Reservation Quest (RQ) makes no representations or warranties of any kind regarding the services offered or provided by Professionals or requested by Clients through the use of the Services, whether in public or private transactions, or offline, or the accreditation, registration or licensing of any Employer.

Neither the Company, its affiliates, nor its licensors are responsible for the conduct of any user of the Services, whether online or offline, and you hereby release the Company, its affiliates, or its licensors from any liability related thereto. The Company, its affiliates, and its licensors shall not be liable for any claim, injury, or damage arising in connection with your use of the Services.

Cancellation Policy

Clients and business owners may reschedule appointments according to available times with the approval of the other party.

In the event of non-compliance or cancellation of the reservation by the customer, the full amount will be deducted. The customer shall bear the full amount and it will be deposited in the employer’s wallet after deducting the service fees.

In the event of non-compliance or cancellation of the reservation by the employer, the amount will be deposited into the customer’s wallet and the employer will bear the full amount of the service fee, which will be deducted from his wallet.

Fees

We reserve the right to modify the prices of Subscription Services at any time upon fourteen (14) days' prior notice. Unless we expressly notify you otherwise, any price change for your membership will take effect on the next billing cycle. You must agree to the fee change in order to continue using the Services. To withdraw your consent, you will need to cancel your account by logging into your account through the Subscription Portal and following the cancellation procedures.

Payment and service fees

Business owners agree to the subscription fees, service fees and value-added tax.

Return Policy

All amounts and fees are non-refundable and non-transferable unless otherwise stated in these terms and conditions.

Trials

RQ may, from time to time, offer trial memberships which include free or discounted access to the Subscription during the designated trial period.

Subscription Cancellation

You may terminate your subscription at any time. Upon cancellation, your access to the app's services will be immediately suspended.

Please note that this action is irreversible. You will not be entitled to a refund of any remaining subscription fees, regardless of the time remaining in the subscription period.

If the Employer has any outstanding earnings on our platform at the time of cancellation (from customer transactions where the service was provided), these funds will be processed and paid to the Employer.

Note: Refunds will be processed and refunded within 30 business days of the cancellation date.

Termination of Accounts

Reservation Quest (RQ) reserves the right, in its sole discretion, to terminate your account if you violate these Terms of Service or for any other reason with or without cause at any time. We may also suspend your access to the Services and your account (including the funds in your account) if you (a) have violated a term of these Terms of Service, or any other agreement you have with Reservation Quest (RQ), including but not limited to the End User License Agreement or Reservation Quest Policies, (b) pose an unacceptable credit or fraud risk to us, (c) provide any false, incomplete, inaccurate, or misleading information or otherwise engage in fraudulent or illegal conduct, or (d) for any other reason in Reservation Quest's sole discretion.

If your account is terminated or suspended for any or no reason, you agree that: (a) you will continue to be bound by these Terms of Service, (b) you will immediately cease using the Services, (c) any licenses granted to you under these Terms of Service will expire, (d) we reserve the right (but have no obligation) to obscure or delete all of your information and account data stored on our servers, and (e) RQ will not be liable to you or any third party for any termination, suspension of access to the Services, deletion, or obscure of your information or account data. You agree that RQ may retain and use your information and account data as needed to comply with investigations and applicable law.

We will not be liable to you for compensation, reimbursement, or damages in connection with your use of the Services, or in connection with any termination or suspension of the Services. Any termination of these Terms of Service will not relieve you of any obligation to pay any fees or costs accrued prior to termination and any other amounts owed to us by you as set forth in these Terms of Service.

Reservation Quest (RQ) is not liable for any losses related to chargebacks, fraudulent charges, or other actions taken by any user that are deceptive, fraudulent, or invalid as determined in Reservation Quest (RQ)'s sole discretion (“Fraudulent Actions”). By using the Services, you release Reservation Quest (RQ) from any liability arising from Fraudulent Actions. You will also use your best efforts to promptly notify Reservation Quest (RQ) of any Fraudulent Actions that may affect the Services. Reservation Quest (RQ) reserves the right, in its sole discretion, to terminate the account of any user who engages in, or enables any other user to engage in, Fraudulent Actions.

Disclaimer

RQ is under no obligation to routinely screen its users, inquire into their backgrounds, or attempt to verify information provided by any user, and does not routinely do so. We reserve the right, but have no obligation, to monitor disputes between you and other users.

RQ makes no representations or warranties regarding the quality, suitability, reliability, timeliness, durability, legality or any other aspect of the Services provided or offered by Professionals or required by Clients through the use of the Services whether in public, private or offline interactions or regarding the accreditation, registration or licensing of any Professional.

Conclusion

I hereby acknowledge that I have read and understood the foregoing Terms of Service, including the Company's Privacy Policy located at https://reservationquest.com/policy and agree that my use of the Services constitutes my agreement to be bound by the terms and conditions of these Terms of Service.
